  1. It is with dismay but not surprise, that the English are still trying to erase Cornwall from
    history, the map & deny its very existence.

    I would like to think that this is just out of ingnorance of the law but the evidence suggests
    otherwise.

    The real and lasting truth lies in the successful submission by the Duchy\x92s Attorney General, Sir George Harrison, in the late 1850s in a spat with the Crown over the latter\x92s greedy attempt to land-grab Cornwall\x92s foreshore. Harrison\x92s submission stated plain fact, describing Cornwall as a Palatine state that had always been held apart from England and that the entire jurisdiction of the Crown within Cornish borders was held by the Duke.
    In other words \x96 and uniquely in Britain \x96 the reigning monarch\x92s writ does not extend to Cornwall

    Under Duchy Charters, the Duke appoints the Sherriff: elsewhere in Britain, including Wales,
    this appointment is made by the monarch. Harrison also pointed out that, irrespective of external land holdings, the Duchy covered the entire area of Cornwall \x96 including the bed and waters of the Tamar.
    This confirms the ancient boundary fixed by Aethelstan 900 years previously as, indeed, does the Tamar Bridge Act 1998 that also confirms the power of the Duke

    Just look at the organisations that operate in Cornwall in direct breach of the Duchy Charters:
    HM Inspector of Taxes, the Crown Prosecution Service, Crown Courts and even the quangos
    created by recent governments: English Heritage, English Nature, English Estates.
    The Government, acting in the name of the Crown, does not allow Cornish children to be taught their own heritage. It even teaches them they are \x93English\x94 and there have been recent complaints against teaching staff who have punished or humiliated Cornish children for insisting upon their true Cornish identity.
    London would be the first to condemn any other nation that was treating a legitimate minority in this way

    This process was never more in evidence than with the state-funded ‘Historical Atlas of
    South West England’ distributed free to all comprehensive school in Cornwall. Here,
    when genuine maps showing Cornwall as one of the four nations of Britain were censored and replaced with fake ones depicting early medieval Cornwall as a county of England

    Whether depicting an English Empire in Britain, or an Anglo-British empire worldwide, when distributed to the communities of subjugated peoples the imperial powers maps not only discredit the previous localised understanding of borders and territory but also help ensure that subsequent generations grow to accept London as their administrative, economic, cultural and spiritual capital. This is one way by which sovereignty over other people is maintained, and the results of such a policy can be seen in Cornwall today.

    The reason for the "Celts don’t exist" argument is, sadly, a political one. It stems from a supremacist mentality that seems determined to undermine internal devolution, to oppose the EU’s adoption of Celtic symbolism to strengthen the case for a unified Europe (Venice 1991) as well as the Atlantic Arc countries’ use of Celtic identity to strengthen opposition to the centralist policies of the London, Paris and Madrid-based governments (Rennes 2001).
    The view of such people, who appear to dominate organisations like ‘English’ Heritage, is that the Celtic dimension is something to be despised and obliterated from the record rather than one
    that would positively enhance both Britain and Europe.
    As a result, Celtic children, particularly in Cornwall, are denied education and knowledge of their own history, culture and language and this in a Britain that claims to champion cultural, ethnic and linguistic diversity.
    This needs to change and the sooner that happens, the better.
    There is now a huge responsibility upon all Education Authorities, from central government
    down to Cornwall Council, to right a very great wrong.

    Historically the Cornish have always viewed themselves as a nation with their own identity who were largely autonomous and had their own language and culture. Much evidence exists in legal documents, maps and quotations to back these claims up and it is recognised that before the 1960’s there was little difference
    between Cornwall and Wales in constitutional terms.

    Many things changed after 1549. No longer do we find Anglia et Cornubia in official documents; the British Sea suddenly became the English Channel and Cornwall as a separate entity was omitted from the maps.

    No record exists of any formal annexation of Cornwall to England, nor was Cornwall party to the Act of Union in 1707.

    Today many Cornish claim that Cornwall has a de jure status apart as a sovereign Duchy extraterritorial to England. A commonly cited basis for this argument is an 1856 court case in which Sir George Harrison successfully argued that the Duchy enjoyed the rights and prerogatives of a County palatine and that the Duke has rights over the whole territory of Cornwall befitting a King.

    The Kilbrandon Report (1969\x961971) into the British constitution recommended that, when referring to Cornwall official sources should cite the Duchy not the County. This was suggested in recognition of its constitutional position.

    In 1977 the Plaid Cymru MP Dafydd Wigley in Parliament asked the Attorney General for England and Wales if he would provide the date upon which enactments of the Charter of Pardon of 1508 were rescinded. The reply, received on 14 May 1977, stated that a Stannator’s right to veto Westminster legislation had never been formally withdrawn.

    In 1997 the Liberal Democrat Andrew George MP attempted to raise a Duchy-related question but he was prevented by an injunction that disallows MPs raising any questions in Parliament that are in any way related to the Duchy.

    Recently Lord Whitty, in the House of Lords, recognised that Cornwall has a "special case" for devolution and on a visit to Cornwall, Deputy Prime Minister, John Prescott said "Cornwall has the strongest regional identity in the UK".

    The Council of Europe has urged the Government to extend the cultural, educational and other benefits of the Framework Convention for the Protection of National Minorities to the Cornish and a 2nd UK report was submited this year with a decision due in late 2006.

    Some progress has been made with the inclusion for the first time of an ethnic code (06) for the Cornish on the 2001 UK Census and the Cornish language was at last officially recognised by the government in 2002, followed by some government funding in 2005.

    Despite all of this at present Cornwall is the only Celtic nation (out of Cornwall, Brittany, Galicia, the Irish Republic, Isle of Man, Northern Ireland, Scotland and Wales) that has no form of effective self-government.

  3. I am a Penryn born Cornishman from the United Kingdom and a growing Cornish and Breton speaker. I have been raised by a family and community that has endowed me with what can be best described as a Cornish national identity, another way to look at it would be of Cornish ethnicity.

    The Cornish are a Celtic ethnic group and nation of the southwest of Great Britain. We have our own lesser used Celtic language (Cornish), sports, festivals, cuisine, music, dance, history and identity. Cornwall also has a distinct constitutional history as a Duchy with an autonomous stannary parliament. This Celtic Cornish identity was recognised and described in the April 2006 edition of National Geographic.

    The results from the 2001 UK population census show over thirty seven thousand people hold a Cornish identity instead of English or British. On this census, to claim to be Cornish, you had to deny being British, by crossing out the British option and then write Cornish in the others box. Additionally the decision to collect information on Cornish identity was extremely badly publicised.

    How many more would have described themselves as Cornish if they did not have to deny being British or if there had been a Cornish tick box? How many people knew that it was an option? How many ticked British but feel themselves to be Cornish British?

    Cornwall Council\x92s Feb 2003 MORI Poll showed 55% in favour of a democratically-elected, fully-devolved regional assembly for Cornwall, (this was an increase from 46% in favour in a 2002 poll). Many English and other nationalities who have settled in Cornwall wish to see an assembly as some of these people identify closely with Cornwall and actually feel \x91Cornish\x92. London, Wales and Scotland have devolved assemblies and are still part of the United Kingdom as well as the Isle of Man, Jersey and Guernsey – why not Cornwall ? The Cornish Assembly petition was signed by 50,000 people, which is the largest expression of popular support for devolved power in the whole of the United Kingdom and possibly Europe.

    In July 2000 Mebyon Kernow launched the Declaration for a Cornish Assembly campaign which some three months later led to the creation of The Cornish Constitutional Convention with the objective of establishing a devolved Assembly for Cornwall. In less than two years, it had won the support of over 50,000 people, which equates to more than 10% of the Cornish electorate. A delegation led by the West Cornwall Liberal Democrat MP Andrew George and representatives of the Cornish Constitutional Convention (Bert Biscoe, Richard Ford, Dick Cole, David Fieldsend and Andrew Climo Thompson) presented 50,000 declarations to 10 Downing Street on Wednesday 12th December 2001 calling for a Cornish Assembly. This was an opportunity to give the people of Cornwall the chance to demand greater control over their own future.

    A recommendation by the Parliamentary Assembly of the Council of Europe (PACE) on the \x91concept of nation\x92 has been backed by the European Parliament regional and minority language Intergroup.

    The PACE recommendation stated that, \x93Everyone should be free to define themselves as a member of a cultural \x93nation\x94, irrespective of their citizenship\x94. In response, the Intergroup commented that \x91Council of Europe member states should avoid defining themselves in exclusively ethnic terms, and should do their utmost to help their minorities, a source of enrichment, to flourish\x92. Today, both the French and the British Governments still deny people from some of the Celtic countries to legally describe themselves in terms of their Celtic national identities in all areas of life. Intergroup leader Mr Csaba Tabajdi, Member of the European Parliament, said that, this recommendation is of utter importance, representing a paradigm change in the protection of minorities in Europe. It contains a new, elaborate concept of nation.

    The recommendation states that: The term \x93nation\x94 is deeply rooted in peoples, culture and history and incorporates fundamental elements of their identity. \x93It is also closely linked to political ideologies, which have exploited it and adulterated its original meaning. Furthermore, in view of the diversity of languages spoken in European countries, a concept such as nation is quite simply not translatable in many countries where, at best, only rough translations are to be found in certain national languages.     The UK government has so far failed to recognise the Cornish people under the Council of Europe\x92s framework convention for the protection of national minorities.

    The UK government has failed to give the people of Cornwall the democratic referendum on greater autonomy and a devolved assembly that they have shown a demand for.

    1) I would like to know your position on national and linguistic minorities and in particular the Cornish question in the United Kingdom.

    2) I would also like to know your thoughts on a devolved Cornish assembly.
