Asked if the Prime Minister agreed with Peter Hain that Gary McKinnon s extradition issue had been badly handled, the PMS said that the Home Secretary s article at the weekend made the position clear; we would not comment on an individual case but the Home Secretary, in this instance would not legally be able to intervene, but that assurances had been sought in terms of the wellbeing of the individual in question. Asked if the Prime Minister thought Mr McKinnon should be extradited and what his view was on him serving his sentence in the UK as the Leader suggested this morning, the PMS said that it would be inappropriate for us to comment on an individual case in that way; the legal situation was set out by the Home Secretary at the weekend. In terms of what happened next we would have to see the results of any court case. Historically it had been the case that people who were tried under extradition had then subsequently served some of their sentence in the UK, but we would not get into what could happen in this individual case. Put that Peter Hain seemed to go completely off message with his comments on this case, the PMS said that the legal position was as set out by the Home Secretary yesterday. Asked if the Prime Minister had complete confidence in Peter Hain, the PMS said yes. Asked if it was true that any PPS or Minister could say what they liked regarding Government policy, the PMS said that she did not accept the characterisation of the situation in that question. Asked if the Government had changed the rules on collective responsibility or if it was too weak to enforce them, the PMS said that Ministers across Government were fully-focussed on the main issues, which were the economy, troops in Afghanistan and real help now for families and businesses. The Government s focus was on these issues rather than on any of the issues raised in the question. I think it is quite deplorable that a British citizen should be treated in this way, especially someone who is suffering from asperges syndrome.

The mind boggles if there nuclear systems are protected in this way. Perhaps we should employ someone who has these talents at GCHQ to protect our security, not persecute him.
