EU Treaty

Asked if the Prime Minister had said yesterday that the Government would continue with the ratification process in this country even if the Irish referendum was won by the "no" campaign, the PMS said that he would not get into hypotheticals, but it had been our long-standing position that the Government had always been clear that the progress of the EU Treaty Bill in Parliament would continue as planned. Asked what the logic was for that given that the Treaty could not stand unless it was unanimously supported, the PMS said that we were getting into hypotheticals. We would give our response to the Irish referendum result once it had happened.

Asked when the bill would come back to Parliament for a third reading, the PMS said the third reading was due some time next week in the Lords. Asked if there was a timetable for it to get Royal ascent, the PMS said it would be best to check with the Foreign Office.

  1. In the light of the issues indicated below, related to the Lisbon Treaty, I wonder why Gordon Brown does not comprehend the Lisbon Reform Treaty in the same way that other European Leaders do.

From Open Europe: A Guide to the Constitutional Treaty {August 2007})

“The good thing is…that all the symbolic elements are gone, and that which really matters – the core – is left.” (Anders Fogh Rassmussen, Danish Prime Minister, Jyllands-Posten, 25 June 2007)

“Only cosmetic changes have been made and the basic document remains the same.” (Vaclav Klaus, Czech President, Guardian, 23 June 2007)
As Valery Giscard d’Estaing, the former French President who chaired the European Convention which drew up the European Constitution, explained in an article in Le Monde, 26 October 2007 titled: European Treaty: the tools are exactly the same, only their order in the toolbox has changed.

“…As far as the content is concerned, the result is that the institutional proposals of the constitutional treaty – the only things which mattered for the members of the European Convention – are in the Lisbon treaty [i.e. the new EU Reform Treaty] in their entirety but in a different order and inserted into previous treaties [i.e. the TEU and TEC(TFEU)]…
…What is the purpose of this subtle manoeuvre? First and above all to escape from the constraint of having to hold a referendum by dispersing the articles and by renouncing the constitutional vocabulary…[for the day when]…men and women, animated by great European ambitions, decide to use them…to rekindle, beneath the ash which is covering it today, the ardent dream of a united Europe.”
