Binyam Mohamed

Asked if the Prime Minister was disappointed with the Court of Appeal judgement in the Binyam Mohamed case, the PMS replied, that the Foreign Secretary has made a statement, which covers the Government’s response, and he has made a further statement in Parliament. The Prime Minister stands firmly against torture and cruel, inhumane and degrading treatment or punishment. We do not condone, collude, encourage or solicit it.

In answer to a further question about the effect of the judgement on intelligence sharing and relations with the United States, the PMS said, the Court has upheld the control principle and only asked the Government to publish the relevant material in the light of disclosures in a US Court. It is a particular set of circumstances. The Foreign Secretary has said the control principle is essential to the intelligence relationship between Britain and the US. The Government fought the case to preserve this principle and the judgement upholds that.
