Asked whether the Prime Minister thought it was premature and unwise to bring Shahid Malik back into Government so quickly, the Prime Minister s Spokesman (PMS) told the assembled press that the Prime Minister would not accept that. The Parliamentary Standards Commissioner (PSC) Sir John Lyon had conducted a number of investigations into Ministers and MPs, where there were many precedents for people not stepping down from their roles while his investigations were ongoing. Asked if the Prime Minister maintained confidence in Shahid Malik, the PMS confirmed that he did. Asked why it was right for Shahid Malik to step down while Sir Philip Mawer held an inquiry, but not while Sir John Lyon held one, the PMS replied that in the first case very serious accusations had been made in relation to the Ministerial Code and it was right, given the nature of that accusation, that Shahid Malik should step down while he was investigated, so the matter could be looked at properly. Sir Philip Mawer found that on the basis of a thorough investigation Shahid Malik had not violated the Ministerial Code. In relation to investigations by the PSC, there were many precedents for people not stepping down from positions while the investigations were ongoing. Put that Tony McNulty had written in his resignation letter that he couldn t stay on as a Minister while the investigation was taking place, the PMS said that that was a matter for Mr McNulty and was a decision taken by him.
