Householder Defence

Asked if the Prime Minister would admit he was wrong when he said the law should be changed regarding the home defending issue, the PMOS said that the Prime Minister had said the law should be reviewed. What was important, as the DPP had said this morning, was to keep a sense of perspective about how many people had been prosecuted; the figures were 11 people in the last 15 years. What the law allowed people to do was to respond instinctively to a situation. What it did not allow was people who acted maliciously or with intent, but there was a very clear distinction. Ken McDonald made it clear this morning when he said that the law was on the side on householders, and prosecutions of householders who had attacked burglars were extremely rare. Unless there had been wholly excessive force against an intruder, the CPS had declined to prosecute those who had seriously injured or even killed a burglar. This was also backed up by Chris Fox, the President of ACPO.

The PMOS said the Prime Minister had been reflecting a degree of public confusion, hence the recent debate resulting in new guidelines, and the leaflet that was produced today by ACPO and the CPS.

  1. Gordon Brown MP
I have disagreement with my local health board and in a position where my judgement is constantly questioned. But many people have braught my atention to your policy on protection on your home using reasoneable force. My landlord is stalking me entering my home interfering with my personal papers and pills reading my diary ridiculing me breaking into my safe and openly remarking on my home and then deniing any knowledge I have on many ocasions asked for Police to inforce my rights as i have taken matters into my own hands but have been harshly punished with hospitalisation using medical law inforced by police i am unable to protect myself against the landlord as they have a good reputation and my family trust them and i cant find the apropriate legal intervention as the landlord can always turn round and say im imagining this last time i blew a fuse and shouted and lefted a peice of furniture from anger which they had pushed me to with extreme pressure over months on purpose so the could call me a loose cannon and send me to hospital i made no contact to the person and she wasnt even upset but my punishment was to be put on a heavy dose of medication for years which left me unable to use my computer and i spent at least a year in bed in my home and this caused my to develop a DVT which will never clear up and i am permanently scarred this is of no significance to these people and i am told just to accept this the health service is ignoring me now and i have a negative reaction from the health service and i feel i dont get any answeres from anyone concerned. They just take the micky this has taken its toll if it was an act of nature or a criminal who perpetrated this then id understand but its the establishment the people who should protect us i would just like answeres and to feel worthwhile and that i can trust the drs again and not to be invaded in my home by people who are earning money in my name saying thier there to help me which is a lie and instead running me into the ground on one hand im being called a wimp and then when it suits them they say i have to go to anger management and always able to say im wrong and confused i want nothing other than what is suposidly my rights please dont ridicule me from this letter and if you could send a reply on your policy on how to use resoneable force to protect yourself in your home when you know the perpetrator is able to turn round and say we have medical records to say he isnt sound of mind and have documentation to back them up
